Judge Smacks Down Portions Of Illegal Arizona Immigration Law

Federal District Judge, Susan Bolton has temporarily blocked the most contentious portions of Arizona’s new immigration law on the eve of its implementation. Yesterday, her court issued a preliminary injunction which prevents the State of Arizona from authorizing its police to question people about their immigration status. She also blocked provisions of the law making it a crime to fail to apply for or carry alien registration papers or “for an unauthorized alien to solicit, apply for or perform work,” and a provision “authorizing the warrantless arrest of a person” if there is reason to believe that person might be subject to deportation.

The federal government opposed the Arizona law because it infringed upon the federal government’s exclusive jurisdiction over immigration laws. The Justice Department successfully claimed that a patchwork of state and local policies would seriously disrupt federal immigration enforcement and would ultimately be counterproductive.

The state of Arizona now has only two options available. It can ask the judge to reconsider her order after more fact finding or it can appeal the case to the 9th Circuit Court of Appeals. The latter is more likely.

So, for the time being,  legal immigrants and citizens of brown complexion can travel throughout Arizona without fear of being asked for “their papers” Thank goodness for that. But we can only wait to hear the reaction from Rush Limbaugh, Michele Bachmann, the Tea Party and Sarah Palin and her cohorts over at Fox News. Do you think Glenn Beck might summon a few crocodile tears for his country? Will Lou Dobbs spontaneously combust? Will John McCain flip-flop again?   1. “House Bill 2013” and “SB1070”

    0 = Arizona
    2 = USA/ Our Constitution/ We the People of the United States

    This month of July 2010, our U.S. Federal courts have found the so called State of Arizona hate filled legislation namely “House Bill 2013” and “SB1070” Un-constitution (So much for the intellect of Jan Brewer, “Did you read the bills you signed?”). But we all know that they will go crying to the Supreme Court of the United States, please, please, please go. We will fight you in Arizona, any other state, and yes in Washington DC. We will not tire, we will not be silent and we will persevere, I promise you.

    In my opinion the Republican Party has been taken over the most extreme of clans; the Baggers, Birthers and Blowhards (people who love to push their beliefs and hate on others while trying to take away the rights of those they just hate) and that’s who they need to extract from their party if they real want to win in November. Good Luck, because as they said in WACO, “We Ain’t Coming Out”.

    It’s all about politics: Jan Brewer you were never elected to be Governor, but you have no problem trying to get elected on the back of undocumented workers, you loser (sure you may win but the long-term effects to your so called State is just beginning). Here is a partial list of your hate filled legislation;

    1. S.B. 1070,
    2. House Bill 2013
    3. No permit conceal weapons law,
    4. The famous Birthers law,
    5. Banning Ethnic studies law,

    6. Could she be behind the Mural in Prescott, Arizona, ordered to be whiten,
    7. On deck to pass, no citizenship to babies born to undocumented workers,

    8. If she can read she should look up Arizona’s House Bill 2779 from two years ago (which was un-constitution and failed when legally challenged),
    9. The boycotted Martin Luther King Day, what idiots don’t want another holiday? Yes, you guessed it Arizona.

    Well Arizona, you can keep boycotting new holidays, passing hate filled legislation and the rest of our country will continue to challenge you in court of law and Boycott your so-called state.

    Lets face it, no one can real believe anything that comes out of Brewer’s mouth, in an interview, this year, in an attempt to gain sympathy, she first said her father had died in Germany fighting the Nazi in World War II (which ended 1945) but of course we find out the truth that father was never in Germany and died in California in 1955. But we are suppose to believe everything else she says, right!

    As they say in the World Cup: Gooooooooal!

  2. Fear ‘n’ Smear

    The fine folks at Pox are surely scrambling to give full, breathless coverage to this scandalous “activist judge” story. They’re praying for huge ratings to follow their fear mongering on uppity coloreds, and their righteous hysteria over fanatical, godless Muslims attending their own churches.

    Not a good day for Sen. Jon Kyl (R-AZ), ardent proponent of SB-1070, champion of the rich, and bible-thumper extraordinaire: He had recommended judge Bolton precisely because of her expertise and fairness!

  3. Let’s just have a boo-hoo pity party for the border jumpers and their corrupt government. Where is it Constitutionally illegal for officers to ask for verification to live here? Hell, the government wants us to carry I.D. cards so they can track us, why not them?

    What about the mutiple deaths of Americans because of illegals? The multiple incursions of the Mexican military across our border? And the high school boys who were suspended for wearing the AMERICAN FLAG because it offended the hispanics on condo de mayo? What in the hell has cinco de mayo done for this country?

    All this escapes the grasp of the liberal media. Throw another pity party for the border jumpers, I’m sure they’ll enjoy it

    • The problem with the Arizona law is that it is illegal because it infringed upon the federal government’s exclusive jurisdiction regarding matters of immigration. If there is not a uniform standard, then each of the 50 states could have conflicting laws which would make the immigration mess worse than it is today. Furthermore, the proposed law would have restricted the rights and freedoms of “brown skinned” legal aliens and residents because even the US citizens of that complexion would be forced to carry their “papers” or face arrest. White citizens would not face the same scrutiny, and the Constitution and Bill of Rights provide for equal protection under the law.

  4. It would be better if states like Arizona tried to address the matter of illegal immigration as opposed to a federal government that stays impotent on the issue. Its clear to see that down through the years Clinton-Bush-Obama had no intentions of enforcing our immigration laws. The only solution they seem to come up with is”pathways to citizenship”.

    And again, where is it un-Constititional to require immigrants to carry their papers? Their not arresting them or performing a series illegal searches and seizures. Its a series of simple questions. “Do you have legal right to live in the United States?” “Can I see your documentation?”

    It a sad reality that hispanics who came here legally have to lumped into category with those who have no respect for our laws, sovereignty, or the Constitution. Again, getting asked to show documentation of legal right to live in the U.S. is not a violation of the Bill of Rights.

    Maybe next time I get pulled over I’ll tell the cop to show my drivers license is a violation my Constitutional rights.

    • It is “unequal protection under law” if only persons that look a certain way are asked for “their papers” while those that are white are not asked to present the same “papers”.

  5. White Lies

    It wasn’t long ago that [Sandoval] said in an interview on Univision that he vehemently supported Arizona’s anti-immigrant law. In reference to the same law, he was asked how he would feel if he his children were stopped in the street and asked for their papers. He answered, with a note of pride in his voice, “my children don’t look Hispanic.”
